2022 Omaha Mobile Stage Waiver and Release
I, ___________________________________________________________________ for myself, hereby completely release and forever discharge Partners for Livable Omaha and Omaha Public Schools Foundation, as well as its officers, directors, agents, representatives and volunteers (collectively, the “Released Entities”), and shall refrain from instituting, pressing, collecting or in any way aiding or proceeding upon any and all claims, judgments, debts, causes of action, suits and proceedings of any kind, at law or in equity, which I ever had, now have, or may hereafter accrue or otherwise acquire against the Released Entities, including, but not limited to, negligence, for property damage, personal injury, or wrongful death, arising out of or related to my participation at Omaha Mobile Stage events and/or my attendance at the Omaha Mobile Stage events itself.
If the participant is under 19 years of age, the participant and the parents having legal custody and/or the legal guardians of the participant also hereby release and forever discharge the Released Entities from any claim whatsoever which arises.
I hereby agree to indemnify and hold harmless the Released Entities, or any of them, from any and all present or future claims, judgments, debts, causes of action, suits and proceedings of any kind, at law or in equity, that may hereafter be made or brought on my behalf on account of any injury, illness, physical condition, inconvenience, accident or loss sustained by me during my participation in Omaha Mobile Stage events or attendance thereat.
I hereby acknowledge and understand the risk of serious illness and death does exist by participating in the events; and knowingly assume the risk of injury, harm, or loss, including any injury or loss caused by the negligence or conduct on the part of the Omaha Mobile Stage events. This also includes all risks related to illness and infectious diseases, such as COVID-19.
Partners for Livable Omaha shall not be financially responsible for cancellation or delay in performance resulting from causes beyond its reasonable control, including, but not limited to: acts of God, strikes or other labor disturbances, equipment failures, epidemics, pandemics, quarantines, government restrictions on gatherings, war, acts of terrorism, riot, floods, fires, tornadoes, earthquakes or other contingencies the non-occurrence of which was a basic assumption underlying the obligations under this agreement.
Further, I hereby agree to abide by the following:
Irresponsible consumption of alcoholic beverages and/or the facilitation of underage drinking are prohibited. Intoxicated belligerence or other signs of impairment related to substance abuse within the venue(s) will result in expulsion from the event(s). Participants are not to consume or be under the influence of alcoholic beverages or illegal drugs during their shift.
We appreciate your cooperation in respecting fellow attendees by smoking in designated areas only. Participants are not to smoke during their shift.
By attending Omaha Mobile Stage events, you consent to being filmed and or photographed, whereas your image, voice, and likeness may be used by the Omaha Mobile Stage events producers for promotional purposes. Any photography taken at Omaha Mobile Stage events, whether in digital or analog format, is subject to mandatory, non-exclusive license to the Omaha Mobile Stage events producers for use in promotions. Any artwork or performances sponsored by the Omaha Mobile Stage events producers or taking place on event grounds is also subject to a mandatory, non-exclusive license to Omaha Mobile Stage events producers for use in promotions.
Omaha Mobile Stage Events Code of Conduct & Harassment Policy
All attendees, volunteers, performers, participants, vendors, and staff contribute to the inclusive, safe, and comfortable environment at Omaha Mobile Stage events.
Offensive, disruptive, and disrespectful behavior will not be tolerated, including but not limited to:
- Language that is verbally abusive, intimidating, or threatening, including unwanted sexual remarks or jokes, racial or ethnic slurs, and demeaning comments on gender or sexual orientation;
- Physical acts of intimidation, stalking behavior, assault, battery, or non-consensual touching;
- Taking and/or distributing harassing or non-consensual video or photo of someone; and
- Unwanted encroachment on someone else’s physical space or otherwise intentionally impeding their ability to enjoy the festival.
All of the above acts are considered harassment, and Partners for Livable Omaha has a zero-tolerance policy for harassment or discrimination of any kind. Any individual or groups found in violation of this policy may be removed from the event and banned from reentering.

It is the policy of Partners for Livable Omaha to not to discriminate against any participant because of race, color, religion, age, sex, creed, ancestry, marital status, national origin, disability, veteran status, sexual orientation, gender identity, gender expression or any other protected status.
This Agreement shall be governed in all respects by the laws of the United States of America and by the laws of the State of Nebraska. Each of the parties irrevocably consents to the exclusive personal jurisdiction of the federal and state courts located in Nebraska, as applicable, for any matter arising out of or relating to this Agreement, except that in actions seeking to enforce any order or any judgment of such federal or state courts located in Nebraska, such personal jurisdiction shall be nonexclusive.
This agreement affects your legal rights, and you may wish to consult an attorney concerning this agreement. I, the undersigned, hereby acknowledge that I have read the foregoing Waiver & Release, understand its contents, and have signed the same as my own free act and deed. Further, by signing hereunder, I also hereby acknowledge and agree that my violation and/or failure to abide by the Code of Conduct can result in my expulsion from the event without warning or advance notice.
